PART A – TERMS AND CONDITIONS OF MEMBERSHIP
Heaths Health and Fitness – 2026 Version
1. Definitions
• “You / Your” – the lead member named on the membership agreement.
• “Linked Member” – any adult or child added to your membership.
• “We / Us / Our / The Club” – Heaths Health and Fitness.
These terms apply to you and all linked members.
2. Acceptance of Membership
2.1 Membership is subject to acceptance by us.
• We may refuse an application due to capacity limits.
• Failed payment checks.
• Previous serious breaches of club rules.
2.2 A contract begins when we confirm acceptance of your membership application (“Joining Date”).
2.3 Upon acceptance, you will receive a QR code, which must be used each time you enter the club.
3. Cooling-Off Period
3.1 If you join online or away from the club, you have 14 days from your Joining Date to cancel for a full refund.
• This applies only if you have not entered the club.
3.2 If you or any linked member enter the club during the cooling-off period, this right is waived.
4. Membership Types
4.1 Annual Membership
• Paid in full in advance for 12 months.
• Non-refundable once the membership has started.
• Automatically ends after 12 months unless renewed by a new agreement.
4.2 Monthly Membership
• Paid monthly by repeat card payment.
• 30 days’ notice required to cancel.
• No minimum term beyond the initial month.
• Any unused credits included within the membership do not roll over.
• Unused credits cannot be carried into the following month.
4.3 Credits & Bookings
• Credits are valid only for the period stated at purchase or allocation.
• To amend or cancel a credit booking, at least 12 hours’ notice is required.
• Failure to give notice will result in the credit being lost.
• Credits cannot be extended, transferred, or reinstated, including where they have expired.
5. Fees & Payments
5.1 Membership fees are displayed in the club and on our website.
5.2 Monthly payments are collected by repeat card payment on the 1st of each month unless otherwise agreed.
5.3 Non-payment may result in:
• Suspension of access.
• Administration fees.
• Referral to debt collection if unpaid.
5.4 Cancelling your repeat card payment does not cancel your membership. Written notice is still required.
6. Freezing Membership
6.1 Monthly memberships may be frozen for 1–6 months per year.
6.2 30 days’ notice is required via email to info@heaths.fit.
6.3 Frozen periods do not count toward your notice period.
7. Ending Your Membership
7.1 Notice must be given by email to info@heaths.fit.
7.2 Membership ends 30 days after we receive notice.
• Or at the end of any frozen period, if applicable.
7.3 Annual memberships cannot be cancelled early unless agreed under special circumstances.
8. Early Termination (Special Circumstances)
You may request cancellation of annual memberships if:
• You develop a medical condition preventing exercise (excluding normal pregnancy).
• You move more than 10 miles from the club.
• The club permanently closes.
Reasonable evidence may be requested.
Any refunds will be proportionate and fair, taking into account time used.
9. Behaviour & Conduct
We may suspend or cancel membership if:
• Staff or members are abused, threatened, or intimidated.
• QR codes are shared.
• Club rules are repeatedly or seriously broken.
Refunds will only be issued in line with clause 8 or for unused monthly fees already paid.
10. Liability
Nothing in these terms limits your statutory consumer rights.
We accept liability where required by law.
11. Data Protection
We comply with UK GDPR and the Data Protection Act 2018.

12. Children
Children must:
• Be accompanied where required.
• Follow club rules.
Persistent behavioural issues may result in suspension.
PART B – CLUB RULES (Condensed)
1. Behaviour & Conduct
• Treat staff, members, and property with respect.
• Abuse, intimidation, harassment, or sharing QR codes may result in suspension or cancellation.
2. Children
• Must be accompanied by an adult when joining.
• Must behave safely and respectfully.
• Persistent issues may lead to temporary suspension.
3. Membership Access
• Use your personal QR code for entry.
• Guests must be registered.
• Members are responsible for guest behaviour.
4. Health & Safety
• Use equipment only if physically capable.
• Disclose medical conditions that affect safety.
• Smoking, vaping, alcohol, and illegal substances are prohibited.
5. Personal Property & Hygiene
• The club is not liable for loss or damage unless due to negligence.
• Use lockers provided.
• Wipe equipment after use.
• Wear appropriate clothing and footwear.
6. Club Access & Classes
• Access may be limited for maintenance or safety reasons.
• Class schedules may change.
• Advance booking may be required.
• Personal trainers must be authorised by the club.
7. Equipment & Resources
• Use equipment responsibly.
• Report faults immediately.
• Access may be limited for safety, maintenance, or fair use.
8. Complaints & Appeals
• Complaints or appeals can be sent to info@heaths.fit.
• Follow the steps: staff → club manager → director.
9. Updates
• Rules may change to improve safety or comply with legal requirements.
• Continued membership implies acceptance of updates.
